Constitutional ruling annuls the protection of aquifers

The Plurinational Constitutional Court (TCP) left the protected conservation areas in the nine departments of the country defenseless, by issuing the constitutional ruling that declares the nullity of several articles of Departmental Law No. 98, on the right of the governorates to manage, create or declare conservation units, protected areas or natural heritage within its autonomous territory.

Representative María René Álvarez warned that this TCP ruling, issued on August 8, sets a disastrous precedent against departmental autonomies and leaves protected conservation areas “defenseless.

According to the legislator, the ruling was issued in August by the TCP and was notified on September 20, almost as a gift from centralism against Santa Cruz, but which establishes jurisprudence for all departments and their governorates.

She said that with the ruling they are taking away from Santa Cruz the right to legislate, to administer and govern in the territory of the department and they are telling the governorates that as subnational governments “they should only dedicate themselves to doing minor works, laying cables or issuing certificates, but the land and territory, including protected areas and natural heritage, will be managed by the centralist Government however it wants.”

On the other hand, the civics of Santa Cruz declare an emergency and call for an inter-institutional meeting. “We demand that the central government respect departmental autonomy and the right that Santa Cruz has to legislate, administer and govern in the territory of the department,” said the vice president of the Pro Santa Cruz Committee.
