The government of President Luis Arce promotes a package of laws that aims to centralize power (even more) in the Executive Branch, which includes the control of much of the personal information of Bolivian citizens. The objective could not be more alarming and sinister.
Among all of them, the most controversial is the Bill against the legitimization of illicit profits that, among other violations, breaks with the principle of presumption of innocence, due process, privacy and professional secrecy (also the source secret that protects to journalists).
This project also subjects the Public Ministry to political power because it creates a national council headed by ministers, which overrides the functions of the Prosecutor’s Office in cases of legitimation of illicit profits.
Nothing had united so many sectors of the country against the Government as this bill that was approved in the Chamber of Deputies and that is ready for treatment in the Senate is doing. To the rejection of the opposition benches, civic groups, citizen platforms, the press union, the national leadership of the unions, the evangelical churches, informal merchants of the city of El Alto, the professionals of Bolivia and the National Chamber have joined. Exporters (Caneb), among others.
Finally, this Friday the Confederation of Private Entrepreneurs of Bolivia made known the most forceful of the positions, requesting that the Legislature paralyze the treatment of the aforementioned bill. Along the same lines, the parliamentary opposition has asked to send the project to a constitutionality control to find out whether or not it is part of the Magna Carta, although judging by the decisions of the Constitutional Court, the interest of the Executive is likely to prevail.
If the government ignores all these sectors, it will probably have to face social tensions in the coming days, even from its own social sectors.
But, this is not the only law questioned by its controlling desire. There is a whole package of projects that seek to strengthen the hegemony of the MAS not only in the institutions, but in the private life of Bolivians.
For example, the Trade Registration Law has already been enacted, which will grant the Ministry of Productive Development the power to create an entity that fulfills the functions that are currently in charge of Fundempresa. In this way, the Executive will concentrate the data of all the undertakings, items, capitals and balance sheets.
In the same way, the Real Rights Bill provides that this entity will no longer belong to the Judicial Organ and that it will pass to the custody of the Ministry of Justice, which will concentrate the information on the properties of the people.
The Police Promotion Law, which is already in force, places the Minister of Government above the police structure, which will allow him to more directly control the repressive and intelligence activities of the State. Opponents denounce that a similar project will be approved for the Armed Forces.
The Anti-Corruption Law is also being questioned due to the extension of criminal responsibility to companies for crimes of corruption of their members, which even implies sanctions such as the loss of legal status. The opposition also questions the continuation of the trial in absentia and the figure of the so-called “effective collaborator”, who would benefit from the termination of the process against him in exchange for a denunciation.
It is clear that these laws were not conceived in isolation, but are part of a plan by the Luis Arce government to centralize the power of institutions and people’s information. While these projects advance in the Legislative, the country is engrossed in three agenda items: the importance of the wiphala, the political persecution against opponents and the confrontations between Yungueño coca growers with the Police.
But, different sectors that feel affected have begun to draw the curtain so that the rest of the country can see what this legislative package intends to do.
El gobierno del presidente Luis Arce impulsa un paquete de leyes que tiene por objeto centralizar el poder (aún más) en el Órgano Ejecutivo, lo que incluye el control de gran parte de la información personal de los ciudadanos bolivianos. El objetivo no podía ser más alarmante y siniestro.
Entre todos, el más polémico es el Proyecto de Ley contra la legitimación de ganancias ilícitas que, entre otras vulneraciones, rompe con el principio de presunción de inocencia, el debido proceso, la privacidad y el secreto profesional (también el secreto de fuente que protege a los periodistas).
Este proyecto, además, somete al Ministerio Público al poder político porque crea un consejo nacional encabezado por ministros, que se sobrepone a las funciones de la Fiscalía en casos de legitimación de ganancias ilícitas.
Nada había unido a tantos sectores del país en contra del Gobierno como lo está haciendo este proyecto de ley que se aprobó en la Cámara de Diputados y que está listo para su tratamiento en el Senado. Al rechazo de las bancadas de oposición, se han sumado cívicos, plataformas ciudadanas, el gremio de la prensa, la dirigencia nacional de los gremiales, las iglesias evangélicas, comerciantes informales de la ciudad de El Alto, los profesionales de Bolivia y la Cámara Nacional de Exportadores (Caneb), entre otros.
Finalmente, este viernes la Confederación de Empresarios Privados de Bolivia hizo conocer la más contundente de las posiciones, pidiendo que el Legislativo paralice el tratamiento del citado proyecto de ley. En la misma línea, la oposición parlamentaria ha pedido enviar el proyecto a un control de constitucionalidad para saber si se enmarca o no en la Carta Magna, aunque a juzgar por las decisiones del Tribunal Constitucional, es probable que prevalezca el interés del Ejecutivo.
Si el Gobierno desoye a todos estos sectores, probablemente en los próximos días tenga que enfrentar tensiones sociales, incluso de sus propios sectores sociales.
Pero, ésta no es la única ley cuestionada por su afán controlador. Existe todo un paquetazo de proyectos que buscan afianzar la hegemonía del MAS ya no sólo en las instituciones, sino en la vida particular de los bolivianos.
Por ejemplo, ya fue promulgada la Ley de Registro de Comercio que otorgará al Ministerio de Desarrollo Productivo la potestad de crear una entidad que cumpla las funciones que a la fecha están a cargo de Fundempresa. De esta manera, el Ejecutivo concentrará los datos de todos los emprendimientos, rubros, capitales y balances.
De la misma forma, el Proyecto de Ley de Derechos Reales prevé que esta entidad ya no pertenezca al Órgano Judicial y que pase a tuición del Ministerio de Justicia, que concentrará la información sobre las propiedades de las personas.
La Ley de Ascensos de la Policía, que ya está vigente, pone al Ministro de Gobierno por encima de la estructura policial, lo que le permitirá controlar de manera más directa las actividades represivas y de inteligencia del Estado. Los opositores denuncian que un proyecto similar se aprobará para las Fuerzas Armadas.
La Ley anticorrupción también está siendo cuestionada por la ampliación de la responsabilidad penal a las empresas por los delitos de corrupción de sus integrantes, que implica incluso sanciones como la pérdida de la personería jurídica. La oposición también cuestiona la prosecución del juicio en rebeldía y la figura del llamado “colaborador eficaz”, que sería beneficiado con la extinción del proceso en su contra a cambio de delación.
Está claro que estas leyes no fueron concebidas de manera aislada, sino que forman parte de un plan del gobierno de Luis Arce para centralizar el poder de las instituciones y la información de las personas. Mientras estos proyectos avanzan en el Legislativo, el país está enfrascado en tres temas de agenda: la importancia de la wiphala, la persecución política contra los opositores y los enfrentamientos entre cocaleros yungueños con la Policía.
Pero, diferentes sectores que se sienten afectados han empezado a correr la cortina para que el resto del país vea lo que este paquetazo legislativo pretende hacer.
