The policies of Evo Morales’ government, continued by Luis Arce, amount to ecocide, biocide, and even environmental genocide, as the fires not only reduced millions of hectares of forest to ashes, but also had a catastrophic impact on indigenous and rural communities, according to lawyer Franz Barrios.

The fire continues to rage uncontrollably in eastern Bolivia, consuming forested areas and the properties of local communities. Additionally, wildlife is suffering from the effects of the man-made fires.

Criticizing Supreme Decree 5225, which establishes a five-year environmental pause, lawyer Franz Barrios Gonzáles warns that it is a “deceptive” measure insufficient to stop forest fires. He argues it is useless in the face of the package of incendiary laws still in force, and that it lacks clarity regarding its duration, restoration mechanisms, and resources available for the biodiversity repopulation proposed by the Council of Ministers.

According to Barrios’ analysis, the effectiveness of the environmental pause decreed by the government will not suffice without a “comprehensive review” of land use policies and management of man-made fires.

“This decree, in terms of normative hierarchy, is useless in relation to all the incendiary laws that are above it and remain harmfully effective,” he stated on his X account, referring to the package of incendiary laws that many activists currently demand to be repealed.

He also warned that the decree does not guarantee that public lands will not be illegally exploited, as it does not specify the restoration mechanisms to be used.

The decree states that public lands affected by fires will be considered “unavailable” for a period of five years until restoration and reuse are completed.

In Barrios’ view, “there is a lack of specificity regarding restoration mechanisms and the necessary control to ensure that unavailable public lands are not exploited illegally during the restoration period.

Additionally, the lawyer noted that there is no detailed information on the financial and technical resources available for the implementation of the Fauna and Flora Repopulation Plan mentioned in the decree. He also pointed out that a prior assessment of the impact of the fires was omitted, which would have helped prioritize the most affected areas.

The package of incendiary laws includes Laws 337, 502, 739, and 952, passed between 2013 and 2017; Laws 740 and 741, enacted in 2015; and Laws 1171 and 1098, passed in 2017 and 2018, all during the governments of the blue party.

ECOCIDAL REGIME

Recalling that her interim administration repealed Evo Morales’ “ecocidal decree” number 4333, former interim president Jeanine Añez strongly stated that the MAS regime has no interest in respecting natural reserves or indigenous peoples.

“The MAS regime feels no respect or care for the people of eastern Bolivia, nor for those in the Andean region. They have allowed the expansion of fires just like the expansion of illegal mining: they pollute the water, destroy the land, and poison the air,” she stated on her X account.

In Añez’s view, Mother Earth became a “rhetorical label” for MAS with the sole purpose of seizing indigenous lands in Beni and Santa Cruz. This was all done “to expand the narco-agricultural frontier and usurp lands they could never lawfully access,” added the lawyer.
