The Judge of Caranavi, as a legal substitute for the Judge of Apolo, scheduled the oral trial hearing for November 15 of this year.

La Paz, October 28, 2023 (ANF).- The Madidi park ranger Raúl Santa Cruz (42) who tried at the end of March to prevent the entry of heavy machinery intended for the illegal exploitation of gold in the protected area, considered with the most biodiversity of the planet, resists the judicial siege promoted by mining operators who initiated an unfounded process against him for fulfilling his functions and defending nature.

On March 30, Raúl Santa Cruz was doing his job at the checkpoint called Santa Cruz del Valle Ameno in the municipality of Apolo, one of the main entrances to Madidi. At the site, the park rangers showed that a caravan of vehicles and heavy machinery (five backhoes, ten dump trucks and three fuel tankers) were trying to enter the conservation area bound for the Virgen de Rosario community, presumably to carry out exploitation activities. Santa Cruz, which is currently in the midst of putting out the fires in the conservation region, recalled that on March 30 of this year, he was trying without success to avoid the passage of the caravan, where he was attacked and threatened by Ramiro Cuevas Echave, known in Apolo for dedicating himself to mining activity within the Madidi National Park and Integrated Management Natural Area.

Despite the unsuccessful control, the caravan of vehicles and heavy machinery entered and caused the mining operator, who reiterated that he was “just another farmer,” to file an unfounded criminal complaint against the park rangers Raúl Santa Cruz and Marcos Uzquiano for the crime of defamation and slander.

Rodrigo Herrera, the defense lawyer, described it as “very strange” that a Sentencing Judge from Apolo has admitted such a complaint against both park rangers, “even though there would be no coherence between the facts that fit the writings in the process”.

The Judge of Caranavi, as a legal substitute for the Judge of Apolo, scheduled the oral trial hearing for November 15 of this year. “The process demands the action of the park ranger, alleging that the reputation and honor of the supposed mining operator who repeats being only a farmer and of the elderly would have been damaged,” Herrera explained in a note from the Committee for the Defense of the Park Rangers of Bolivia. .

Let the trial come

“I want that day (hearing of the oral trial on November 15) to arrive once for all, because it is a lot of worry/concern, I only complied with the respective monitoring and control, and required authorization for the entry of that machinery,” said Santa Cruz and confirmed his commitment to enforcing the rules that govern management in Bolivia’s protected areas, “where no mining activity should exist.”

According to Herrera, the judicial hearing will determine the guilt or not of the park rangers and the judicial authority can issue a sentence of up to three years in prison, if the unfounded process is considered appropriate.

Previous hearings

The oral trial hearing is scheduled to take place after three conciliation hearings that did not reach an agreement between the parties.

The first, on May 5, was suspended because the park rangers had not been notified; the second on July 6, one of them was not present; and the third on July 25, the plaintiff Ramiro Cuevas did not want to conciliate and the park ranger Raúl Santa Cruz reiterated that his actions were based on the fulfillment of his duties.

There are international agreements that protect environmental defenders dedicated to working on the conservation of protected areas. However, they are not being respected, and the park rangers are not supported by the State authorities themselves.

Despite this, Raúl Santa Cruz, who is currently putting out the fires in Madidi, claimed to have “well-strengthened morale for having done his job by conserving and protecting the largest and most unique biodiversity in the world,” reflected the Committee.
