The decadent state of the MAS

It was the American philosopher and academic John Rawls who formulated the concept of the rogue state, which is also known as the failed state. If the State is the politically and legally organized society and also the institution that exercises the legitimate monopoly of violence, force or coercion, then what does an outlaw State or failed State mean?

A failed State is defined as one that does not exclusively exercise coercion and does not respect human and constitutional rights, the positive laws approved by a community and that also violates its ethical and social norms. Thus, outlaw or failed states have weak policies, institutions, and governments.

According to political scientists, a failed state is strongly contaminated by high levels of corruption, crime and citizen insecurity; the loss of control of the territory or of the legitimate monopoly of force or coercion is notorious; it has a collapsed judicial system; is unable to provide basic services; it has high levels of informality and poverty and lacks the institutional capacity to interact with other states as a member of the international community.

In a failed State, there is no respect for the Constitution that grants validity to the other norms; political power is exercised without separation of functions and is concentrated in the Executive; there is no effective control and oversight of the exercise of political power and the protection and promotion of human rights is non-existent.

The description fits what we see daily in the country. The Government violates the Constitution and the regulations, for example, by judging former president Jeanine Áñez in ordinary justice and not through a trial of responsibilities; drug trafficking is rampant not only in the Cochabamba tropics but also in border regions with Chile, where smuggling and stolen cars also operate, and in the north of La Paz, illegal and predatory gold mining takes place without any control; the State does not control these areas, where human trafficking also grows. Democratic institutions to protect human rights do not work: the interim ombudsman has dedicated herself to defending power.

In addition, corruption has reached intolerable limits with the embezzlement of the Indigenous Fund or with direct contracting shrouded in opacity and secrecy. There are police chiefs involved in drug trafficking and car theft; the Police are not capable of guaranteeing internal security and even less so to protect citizens from delinquency, because they are the first to break the rules and commit crimes.

Justice is in a state of decomposition and condemns the innocent and even kills those who have denounced official corruption, such as Marco Aramayo. Rampant poverty is another characteristic of this period.

In short, the MAS administration, for almost two decades, has led the country to dangerously take on the physiognomy of an outlaw or failed state. And it will not be easy to get rid of this stigma.

El Estado decadente del MAS

Fue el filósofo y académico estadounidense John Rawls quien formuló el concepto de Estado forajido, que se conoce también como Estado fallido. Si el Estado es la sociedad política y jurídicamente organizada y también la institución que ejerce el monopolio legítimo de la violencia, fuerza o coerción, entonces, ¿qué significa un Estado forajido o Estado fallido? 

Se define a un Estado fallido como aquel que no ejerce exclusivamente la coerción y no respeta los derechos humanos y constitucionales, las leyes positivas aprobadas por una colectividad y que vulnera, también, sus normas éticas y sociales. Por tanto, los Estados forajidos o fallidos tienen políticas, instituciones y gobiernos débiles. 

Según los politólogos, un Estado fallido está fuertemente contaminado por altos niveles de corrupción, criminalidad e inseguridad ciudadana; es notoria la pérdida de control del territorio o del monopolio legítimo de la fuerza o coerción; posee un sistema judicial colapsado; es incapaz de suministrar servicios básicos; tiene altos niveles de informalidad y pobreza y carece de capacidad institucional para interactuar con otros Estados como miembro de la comunidad internacional.

En un Estado fallido, no hay respeto a la Constitución que otorga validez a las demás normas; el poder político se ejerce sin separación de funciones y está concentrado en el Ejecutivo; no hay un efectivo control y fiscalización del ejercicio del poder político y es inexistente la protección y promoción de los derechos humanos.

La descripción se ajusta a lo que vemos cotidianamente en el país. El Gobierno viola la Constitución y las normas, por ejemplo, al juzgar a la expresidenta Jeanine Áñez en la justicia ordinaria y no mediante un juicio de responsabilidades; el narcotráfico campea no sólo en el trópico cochabambino sino también en regiones fronterizas con Chile, donde también operan el contrabando y el tráfico de autos robados, y en el norte de La Paz se desarrolla, sin control alguno, la minería ilegal y depredadora del oro; el Estado no controla esas zonas, donde también crece la trata de personas. Las instituciones democráticas para proteger los derechos humanos no funcionan: la defensora del pueblo interina se ha dedicado a defender al poder. 

Además, la corrupción ha llegado a límites intolerables con el desfalco al Fondo Indígena o con las contrataciones directas sumidas en la opacidad y el secretismo. Hay jefes policiales involucrados en el narcotráfico y en el robo de autos; la Policía no es apta para garantizar la seguridad interna y menos para proteger a la ciudadanía de la delincuencia, porque es la primera en vulnerar las normas y cometer delitos.

La justicia está en estado de descomposición y condena a inocentes y hasta mata a aquellos que han denunciado la corrupción oficialista, como Marco Aramayo. La pobreza rampante es otra de las características de este periodo.

En suma, la administración masista, por casi dos décadas, ha llevado al país a tomar peligrosamente la fisonomía de un Estado forajido o fallido. Y no será fácil liberarse de este estigma.
