Arrest of financial TikToker sparks controversy over freedom of expression, while ASFI defends its complaint

The arrest in Santa Cruz of Juan Carlos Villafuerte, a TikToker focused on finance and cryptocurrencies, has ignited a controversy surrounding freedom of expression and criticism of the financial system amid widespread distrust and crisis.

The Financial System Supervisory Authority (ASFI), in an official statement, justified its March complaint against Villafuerte for having stated on TikTok: “Banks in Bolivia are in danger” and “you can no longer keep your money in the bank, because… you’re losing money… that’s the reality,” explicitly naming financial institutions.

ASFI argued that “any person who, through any means, generates or disseminates false, biased, or malicious information that could undermine confidence in the National Financial System (SFN), commits a financial offense under subsection f) of Article 363 quater of the Penal Code if such information induces or causes mass deposit withdrawals, harming the image or stability of the SFN.”

It further noted that such conduct carries harsh penalties, ranging from 5 to 10 years in prison.

Meanwhile, politicians, public figures, and organizations have expressed their support for the TikToker. Libre’s vice-presidential candidate, Juan Pablo Velasco, said that Juan Carlos Villafuerte is the victim of a massive injustice, having been detained “just for trying to help Bolivian youth protect their wealth through technology.”

The National Association of Journalists of Bolivia (ANPB) stated that this case is a clear violation of the right to freedom of expression.

“This type of action sets a dangerous precedent for the exercise of democratic freedoms and sends an intimidating signal to citizens and digital content creators,” the journalists’ union said.

Economist Gonzalo Chávez described the arrest as “an intolerable abuse and a direct attack on freedom of expression.” He called for Villafuerte’s immediate release and an end to the arbitrary persecution.

Ombudsman Pedro Callisaya called the case “a disproportionate use of the State’s punitive power.” “You cannot attack the freedom of expression of the Bolivian people,” he added.

The TikToker’s mother denounced the arrest as abusive, claiming her son was never summoned but rather “kidnapped.” She noted that the Public Prosecutor’s Office had already dismissed the complaint and that the arrest warrant was no longer valid.
