Jerjes Justiniano says there are grounds to prosecute Vice President Lara

Lawyer and former politician Jerjes Justiniano stated that there are grounds to initiate a trial of responsibilities against Vice President Edmand Lara for alleged breach of duties. He maintained that Lara would not be fulfilling his coordination role, as established by the Political Constitution of the State (CPE).
“A trial of responsibilities can be initiated against him for breach of duties because he does not coordinate, does not act as president of Congress, does not act in support of the executive branch,” the political analyst said on the program La Mañana en Directo, on ERBOL.
Article 174 of the CPE states that the powers of the vice president include “coordinating relations between the Executive Branch, the Plurinational Legislative Assembly, and the autonomous governments.”
Justiniano asserted that “nowhere in the world” has a vice president confronted the president or declared himself an opponent of the government of which he is a member.
“If he is an opponent of the government, he should step down from the government, resign from Parliament, lead a political party, and ask the people for their vote so that the people support him. (…) What is he seeking? Is he trying to bring him down? An opponent wants to come to power, wants to bring down his political adversary,” he stated.
On the other hand, he indicated that, by analogy, the provisions of electoral law for deputies and council members who abandon their political party could be applied. He explained that this regulation establishes that the seat belongs to the political organization, although he acknowledged that there is no similar tradition regarding the nomination of president and vice president.

El abogado y expolítico Jerjes Justiniano afirmó que existen elementos para iniciar un juicio de responsabilidades contra el vicepresidente Edmand Lara por presunto incumplimiento de deberes. Sostuvo que no estaría cumpliendo su atribución de coordinación, tal como establece la Constitución Política del Estado (CPE).
“Se le puede iniciar un juicio de responsabilidades por incumplimiento de deberes porque no coordina, no actúa como presidente del Congreso, no actúa en función de apoyar al poder ejecutivo”, dijo el politólogo en el programa La Mañana en Directo, por ERBOL.
El Artículo 174 de la CPE señala que son atribuciones del vicepresidente “coordinar las relaciones entre el Órgano Ejecutivo, la Asamblea Legislativa Plurinacional y los gobiernos autónomos”.
Justiniano afirmó que “en ninguna parte del mundo” un vicepresidente se ha enfrentado con el presidente o se declaró opositor al gobierno del que forma parte.
“Si es opositor del gobierno, bájese del gobierno, renuncie al Parlamento, dirija un partido político y pídale el voto al pueblo para que el pueblo lo apoye. (…) ¿Qué busca? ¿Lo busca tumbar? Un opositor quiere llegar al poder, quiere tumbar a su adversario político”, señaló.
Por otro lado, indicó que podría aplicarse por analogía lo dispuesto en la ley electoral para diputados y concejales que abandonan su partido político. Explicó que esa normativa establece que el curul pertenece a la organización política, aunque reconoció que no existe una tradición similar respecto a la nominación de presidente y vicepresidente.
