Tribunal Agroambiental recognizes the Tuichi River as a subject of rights and bans mining in its waters

The resolution orders environmental precautionary measures to prevent risks to the river’s biodiversity and protect public health from pollution.

The Plenary Chamber of the Agro-Environmental Court ruled this Friday that the Tuichi River and its ecosystem are subjects of rights, and ordered environmental precautionary measures. As a result, mining operations carried out in its waters and surrounding areas must be suspended.

This is the second resolution issued by this judicial body to protect Amazonian rivers. The first was a ruling ordering the immediate suspension of all mining activities operating outside the grid areas authorized by AJAM in the Madre de Dios River.

Precautionary measures for the Tuichi were filed in May of this year due to threats to the ecosystem from gold exploitation. The court reached its decision after conducting studies on the river’s condition.

Among the damages identified, according to the resolution, are the alteration of the riverbed due to machinery use, destruction of forest areas along the banks and surrounding zones, and contamination of the waters.

Therefore, a “forensic report by the Inter-Institutional Working Group on Responsible Gold (GITOR) within 30 calendar days” has been ordered. This assessment is expected to evaluate the damage already caused and establish measures to prevent further impacts.

The Tuichi River is of great environmental importance, as it runs through the Madidi National Park nature reserve in northern La Paz. Damage to its ecosystem also affects the Indigenous communities living on its banks or near its waters.
