Illegal mining in Parque Madidi is an undeniable issue
- The result of the Popular Action demanding an ecological pause in the territory of the Madidi National Park has not yet been defined. The tie between two members will be defined by a third party.
After the judicial decision to postpone the ruling related to the Popular Action raised by parliamentarians from the Citizen Community (CC) to stop illegal mining activity in the area of the Madidi National Park until the ruling is broken, summoning a ruling member, Senator Cecilia Requena Zárate , affirmed that the seriousness of this problem makes it undeniable for the Government and the big mining interests.
“The problem of illegal mining in Madidi is so undeniable, that despite all the advantages in favor of the Government and powerful mining interests, the Popular Action case was not closed either,” Requena said through her social networks.
In Requena’s opinion, the arguments presented by government agencies “washed their hands” and denied the problem, entering into contradictions to finally load the full burden of proof on third parties. “There is evidence of mercury poisoning thanks to the work of civil society, but they asked us as senators for more studies,” she questioned.
The legislator, in addition, reproached that mining interests have attended the Popular Action hearing, conveniently presented as peasants, to try to intimidate the acting legislators by resorting to confrontation and hatred.
“People were stationed in front of the Court with detonations of firecrackers that often made it impossible to hear what was said in the room and with particular intensity when the plaintiff expressed himself,” she said.
These questions come after the hearing of Popular Action, installed last Friday by the Fourth Constitutional Chamber of the Departmental Court of Justice of La Paz, which failed to issue a unanimous ruling, due to the tie in the positions of the members who make up.
In this action, the fulfillment of the duties are demanded to the Ministry of Environment and Water and the Ministry of Mining and Metallurgy and their respective key instances, the Mining Administrative Jurisdictional Authority – AJAM and the National Service of Protected Areas – Bolivia, so that more irreversible damage to the area is avoided.

Tras la determinación judicial de postergar el fallo relacionado a la Acción Popular planteada por parlamentarios de Comunidad Ciudadana (CC) para detener la actividad minera ilegal en la zona del Parque Nacional Madidi hasta desempatar el fallo, convocando un vocal dirimidor, la senadora Cecilia Requena Zárate, afirmó que la gravedad de este problema hace que sea inocultable para el Gobierno y los grandes intereses mineros.
“Es tan inocultable el problema de la minería ilegal en el Madidi, que a pesar de las todas las ventajas a favor del Gobierno y de poderosos intereses mineros, tampoco se cerró el caso de la Acción Popular”, expresó Requena a través de sus redes sociales.
A criterio de Requena, los argumentos presentados por instancias de Gobierno “se lavaron las manos” y negaron el problema, entrando en contradicciones para finalmente cargar todo el peso de la prueba en terceros. “Existen pruebas de envenenamiento por mercurio gracias al trabajo de la sociedad civil, pero nos pidieron más estudios a nosotras como senadoras”, cuestionó.
La legisladora, además, reprochó que intereses mineros hayan asistido a la audiencia de Acción Popular, convenientemente presentados como campesinos, para intentar amedrentar a los legisladores accionantes recurriendo a la confrontación y el odio.
“Apostaron gente ante el Juzgado con detonaciones de petardos que, a menudo, impedían escuchar lo que se decía en la sala y con particular intensidad cuando se expresaba la parte accionante”, sostuvo.
Estos cuestionamientos se dan tras la audiencia de Acción Popular, instalada el pasado viernes por la Sala Constitucional Cuarta del Tribunal Departamental de Justicia de La Paz, misma que no logró emitir un fallo por unanimidad, ante el empate en las posturas de los vocales que lo componen.
En esta acción se demanda el cumplimiento de deberes del Ministerio de Medio Ambiente y Agua y el Ministerio de Minería y Metalurgia y sus respectivas instancias clave, la Autoridad Jurisdiccional Administrativa Minera – AJAM y el Servicio Nacional de Áreas Protegidas – Bolivia para que se eviten más daños irreversibles en la zona.
