We won’t bend

Los Tiempos has established a clear position regarding the cunning and harmful campaign of economic suffocation that has been applied against it: it will not be bowed down. In other words, this newspaper is aware that the purpose of these attacks is to curtail the right to freedom of expression and letting this attack take its course will affect not only the newspaper, but also society and, consequently, the foundations of democracy.

It is not only that this newspaper rejects the political and arbitrary use of public advertising, which violates the Political Constitution of the State and the American Convention on Human Rights, because it is instrumentalized as a mechanism to reward those media outlets that reproduce, such as transmitters, the discourse of power and punish those who practice independent, critical journalism and who seek to inform and denounce the excesses and abuses of power, but has fundamentally denounced that indirect means are applied, under the control of the State, that violate, as expressed in the aforementioned Pact of San José, the human and constitutional right to freedom of expression.

We have identified those indirect means: tax examinations, one after another, in order to establish charges and penalties; audits of the state business authority, AEMP, with the same purpose and also pressure from the justice submissive to the MAS. This strategy of harassment and suffocation is executed in order to achieve the transfer of control of the company to a businessman linked to the MAS, Eduardo Valdivia Zambrana, who has shown that he can manipulate such indirect means and, in addition, intervene in the sale of unproductive assets owned by the publishing company of Los Tiempos, with the unequivocal purpose of preventing the financial situation of the newspaper from improving and, consequently, consolidating ownership in its favor, to transform the newspaper into a sounding board for power.

What Los Tiempos considers unacceptable is that Valdivia Zambrana activates, through the ICC company, which bought the minority shares of former partner Mauricio Canelas Montaño, these indirect means to consolidate its hostile attitude, with the aim of laying a siege and preventing this journalistic house from sell unproductive assets to get around the crisis. It is not questionable to be a media outlet affected by the crisis, aggravated even more by the pandemic: does not our newspaper share this difficult situation with other media outlets in the world and other companies in the country, journalistic or not, that experience the same problems? What is questionable is that indirect means of pressure are activated, such as tax audits and the state authority of companies and even the justice system, very well described as “rotten”, to prevent our parent company from getting afloat.

Inter-American jurisprudence is clear in linking the manipulation of these indirect media with the violation of the human and constitutional right to freedom of expression. The news media have the right to carry out their work independently. By restricting the freedom of expression of a media outlet, the right of people to receive information is also violated. And it is for this reason that Los Tiempos will not give in and will maintain its line of almost 80 years of free journalism, in search of the truth, to strengthen democracy.

No nos doblegaremos

Los Tiempos ha establecido una posición clara con respecto a la artera y nociva campaña de asfixia económica que se ha aplicado en su contra: no se dejará doblegar. Es decir, este diario está consciente de que el propósito de estos ataques es cercenar el derecho a la libertad de expresión y dejar que esta acometida siga su curso afectará no sólo al diario, sino también a la sociedad y, en consecuencia, a los fundamentos de la democracia.

No es solamente que este diario rechaza el uso político y arbitrario de la pauta publicitaria pública, lo cual vulnera la Constitución Política del Estado y la Convención Americana sobre Derechos Humanos, porque es instrumentalizada como un mecanismo para premiar a aquellos medios que reproducen, como correas transmisoras, el discurso del poder y castigar a aquellos que practican un periodismo independiente, crítico y que busca informar y denunciar los excesos y abusos del poder, sino que fundamentalmente ha denunciado que se aplican medios indirectos, bajo el control del Estado, que vulneran, como expresa el citado Pacto de San José, el derecho humano y constitucional a la libertad de expresión.

Hemos identificado esos medios indirectos: fiscalizaciones impositivas, una tras otra, con el fin de establecer cargos y penalizaciones; fiscalizaciones de la autoridad empresarial del Estado, AEMP, con el mismo fin y también presiones de la justicia sumisa al MAS. Esta estrategia de acoso y de asfixia se ejecuta con el fin de lograr el traspaso del control de la compañía a un empresario vinculado al MAS, Eduardo Valdivia Zambrana, quien ha demostrado que puede manipular tales medios indirectos y, además, interponerse en la venta de los bienes improductivos que posee la empresa editora de Los Tiempos, con el inequívoco fin de impedir que mejore la situación financiera del diario y, en consecuencia, consolidar la propiedad a su favor, para transformar al periódico en una caja de resonancia del poder. 

Lo que Los Tiempos considera inaceptable es que Valdivia Zambrana active, mediante la compañía ICC, que compró las acciones minoritarias del exsocio Mauricio Canelas Montaño, esos medios indirectos para consolidar su actitud hostil, con el objetivo de tender un cerco e impedir que esta casa periodística venda bienes improductivos para sortear la crisis. No es cuestionable ser un medio aquejado por la crisis, agravada aún más por la pandemia: ¿no comparte nuestro periódico esta difícil situación con otros medios del orbe y otras empresas del país, periodísticas o no, que experimentan los mismos problemas? Lo cuestionable es que se activen medios indirectos de presión, como las fiscalizaciones impositivas y de la autoridad estatal de empresas y hasta de la justicia, muy bien calificada como “podrida”, para impedir que nuestra empresa matriz salga a flote. 

La jurisprudencia interamericana es clara al vincular la manipulación de estos medios indirectos con la vulneración del derecho humano y constitucional a la libertad de expresión. Los medios informativos tienen derecho a realizar su labor en forma independiente. Al restringir la libertad de expresión de un medio, también se lesiona el derecho de las personas a recibir información. Y es por esa razón que Los Tiempos no se doblegará y mantendrá su línea de casi 80 años de periodismo libre, en búsqueda de la verdad, para fortalecer a la democracia.
