Libre Launches Impeachment Proceedings Against Evo Morales Over Hotel Las Américas Case

The Libre alliance formally filed an accusation on Friday against former President Evo Morales and Álvaro García Linera, seeking to initiate an impeachment trial over human rights violations committed in the Hotel Las Américas case.

In this case, Morales is accused of responsibility for the April 2009 raid on the Hotel Las Américas, which left three people dead, and the arrests of individuals accused of terrorism and separatism. The case reached the Inter-American Commission on Human Rights (IACHR), which determined that human rights violations had occurred, including extrajudicial executions.

The formal accusation was submitted to the Attorney General’s Office in Sucre. Under the applicable procedure, if sufficient grounds for prosecution are found, the case must be referred to the Legislative Assembly, where authorization to proceed with the trial requires a two-thirds majority.

“The Hotel Las Américas case already has a ruling from the IACHR, which considers that what happened that night constituted crimes against humanity. Summary executions took place that night. Three people were killed, while others were subjected to abuse after being unjustly imprisoned,” said Representative Antonio Pino, who submitted the accusation.

On April 16, 2009, police forces raided the Hotel Las Américas in Santa Cruz, killing Bolivian-Hungarian Eduardo Rozsa, as well as Europeans Arpad Magyarosi and Michael Dwyer. Dwyer’s family and the survivors of the operation appealed to the IACHR, which ruled in their favor, finding that the State had violated their rights.

Morales is specifically implicated in the case because he acknowledged ordering the operation.

Representative Pino announced that further trials against Evo Morales are also being pursued, including over the deaths in the La Calancha case, which occurred during the conflict over Sucre’s bid to become the country’s capital.

“We will now see whether the Legislative Assembly approves this trial by a two-thirds majority. We will see who truly agrees with what happened over the past 20 years and who is genuinely willing to take concrete action on these matters,” he concluded.

La alianza Libre ha formalizado este viernes una proposición acusatoria contra el expresidente Evo Morales y Álvaro García Linera, con miras a instalar un juicio de responsabilidades por las vulneraciones a derechos humanos cometidas en el caso Hotel Las Américas.

En este caso, se acusa a Morales por el operativo en el Hotel Las Américas de abril de 2009, que dejó tres fallecidos, y las detenciones de ciudadanos presuntamente acusados de terrorismo y separatismo. El caso llegó a la Comisión Interamericana de Derecho Humanos (CIDH), la cual estableció que hubo vulneraciones de derechos, como ejecución extrajudicial.  

La proposición acusatoria se presentó ante la Fiscalía General en Sucre. Según el procedimiento, en caso de hallarse materia justiciable, el caso debe ser remitido a la Asamblea para aprobar el enjuiciamiento por dos tercios.

“El caso Hotel las Américas ya tiene un pronunciamiento de la CIDH, que considera que lo ocurrido aquella noche pasa a ser delitos de lesa humanidad. Han existido esa noche ejecuciones sumarias. Han asesinado a tres personas, como el otro asunto que han sufrido vejámenes al haber sido encarcelados de manera injusta”, señaló el diputado Antonio Pino, encargado de hacer la presentación.

El 16 de abril de 2009, fuerzas policiales irrumpieron en el Hotel Las Américas de Santa Cruz, donde mataron al boliviano-húngaro Eduardo Rozsa, además de los europeos Arpad Magyarosi y Michael Dwyer. La familia de éste último y los sobrevivientes del operativo acudieron a la CIDH, que les dio la razón en el sentido de que el Estado vulneró sus derechos.

Evo Morales señalado en este caso particularmente porque reconoció haber ordenado el operativo.

El diputado Pino anunció que la intención es realizar más juicios contra Evo Morales, como por las muertes en el caso La Calancha ocurridas durante el conflicto por capitalía en Sucre.

“Ahora vamos a ver en la Asamblea Legislativa que tiene que aprobar este juicio por dos tercios. Vamos a ver realmente quiénes están de acuerdo con lo que ha ocurrido estos 20 años pasados y quiénes realmente con este tipo de acciones concretas”, finalizó.
