Bolivia is deinstitutionalized

As never before, our country today is totally deinstitutionalized. Practically a majority of the public institutions that make up the national State are with interim authorities or with authorities finger-pointed by the official party that governs us.

A pathetic case is the Ombudsman’s Office, which for six years has been aimless and without a suitable titular authority and with improvised human resources, in addition without fulfilling its true function, which is to ensure the validity, promotion, dissemination and fulfillment of human rights. individual and collective human rights, established by the Political Constitution of the State (CPE), laws and international instruments.

Another worrying case is that of the institutions that make up the Bolivian judicial system; Plurinational Constitutional Court, Judicial Branch, Public Ministry and National Police. None of these four entities enjoys the credibility of the citizenry. A profound restructuring and depoliticization of the same is urgently needed. Just as their daily tasks go, before becoming protectors of society they imply that they are quite the opposite.

The Electoral Body is also immersed in its political labyrinth, the function that its members carry out is not credible, because it is an open secret that its current members, who make up its plenary room, are all masistas, which demonstrates the little institutionality and transparency that we have in this power of the State. Which suggests that we currently have a “non-partial electoral referee.”

The Legislative Branch is another institution that does not give the population confidence in what it does, because, before being a true temple of democracy, in recent times it has become a boxing or wrestling ring. Where its members, before using reason, use brutality or deafening noises to make their ideas or legislative proposals prevail. It has definitely become a make-me-laugh circus. A majority of the people who hold the position of political advisers to senators and deputies, especially the ruling party, do not even have a highschool diploma.

Not to mention the Executive Body, where if one is not a militant of the Movement Towards Socialism (MAS), there is no place to enter to work in it. There have been no institutionalized positions for a long time, almost all the public servants who work in the different departments that make up the public sector were elected due to partisan favoritism and, in many cases, do not even have an academic professional training. Many will say that this is nothing new, since in neoliberal governments it was also taken over by supporters of the governments of the day. Sure, but the difference was that in order to start working in any of its institutions, minimum professional conditions were required. There were no functional illiterates.

With respect to the Comptroller General of the State, it is another entity that follows the path of those previously mentioned. A large part of the population does not know about the activities that it would be carrying out in accordance with what the CPE says. Much less does he know who his highest executive authority is. It is totally invisible.

Now with the uncovered case of the university “old-timer” leader, Max Mendoza, who at 52 years of age and remaining as a so-called “student” for 30 years, earning a hefty salary of almost 22,000 Bolivians, also calls into question the national public university system. Aspect that demonstrates another total shameful deinstitutionalization and corruption within these higher education entities.

All this has an origin, the arrival of the MAS to power since 2006. A political instrument that entered with the desire to sweep away everything that was linked to republicanism, neoliberalism and the traditional middle class that gave it its large vote so that it is where is it now A single example of all this was that, based on the poorly designed idea they had to elect magistrates from all the levels that make up the Judicial Branch by popular vote and after the first judicial elections held in 2011, as of 2012, all positions in the jurisdictional and administrative spheres began to be deinstitutionalized, where before there were technicians specialized in their functions, who fulfilled them professionally.

The way things are going, simply “Bolivia… is dying on us”.

Como nunca antes, nuestro país hoy se encuentra totalmente desinstitucionalizado. Prácticamente una mayoría de las instituciones públicas que conforman el Estado nacional está con autoridades interinas o con autoridades nombradas a dedo por el partido oficialista que nos gobierna.

Un caso patético es la Defensoría del Pueblo, que hace seis años está sin rumbo y sin una autoridad titular idónea y con recursos humanos improvisados, además sin cumplir su verdadera función, que es velar por la vigencia, promoción, difusión y cumplimiento de los derechos humanos individuales y colectivos, que establecen la Constitución Política del Estado (CPE), las leyes y los instrumentos internacionales.

Otro caso preocupante es el de las instituciones que conforman el sistema judicial boliviano; Tribunal Constitucional Plurinacional, Órgano Judicial, Ministerio Público y Policía Nacional. Ninguno de estos cuatro entes goza de la credibilidad de la ciudadanía. Urge una reestructuración y despolitización profunda de las mismas. Así como van sus tareas que desarrollan a diario, antes que convertirse en protectores de la sociedad dan a entender que son todo lo contrario.

El Órgano Electoral está igualmente sumergido en su laberinto político, no es creíble la función que desarrollan sus vocales, porque es un secreto a voces que sus actuales integrantes, que conforman su sala plena, todas y todos son masistas, lo cual demuestra la poca institucionalidad y transparencia que se tiene en este poder del Estado. Lo que da a entender que actualmente tenemos un “árbitro electoral bombero”.

El Órgano Legislativo es otra institución que no da confianza a la población en lo que realiza, pues, antes de ser un verdadero templo de la democracia, en los últimos tiempos se ha convertido en un ring de boxeo o de lucha libre. Donde sus integrantes, antes de usar la razón usan la brutalidad o ruidos ensordecedores para hacer prevalecer sus ideas o propuestas legislativas. Definitivamente el mismo se ha convertido en un circo del hazme reír. Una mayoría de las personas que desempeñan el cargo de asesores políticos de senadores/as y diputados/as, especialmente del oficialismo, no tiene ni siquiera títulos de bachiller.

Ni qué decir del Órgano Ejecutivo, donde si uno no es militante del Movimiento Al Socialismo (MAS), no tiene cabida para ingresar a trabajar en el mismo. Hace tiempo que no hay cargos institucionalizados, casi todos las/los servidores públicos que trabajan en las distintas reparticiones que conforman dicho sector público fueron elegidas/os por favoritismo partidario y, en muchos casos, ni tienen una formación profesional académica. Muchos dirán que eso no es novedad, ya que en gobiernos neoliberales igualmente estuvo copado por partidarios de los gobiernos de turno. Claro que sí, pero la diferencia estuvo en que para entrar a trabajar en cualquier de sus instituciones se exigía condiciones mínimas profesionales. No entraban analfabetos funcionales.

Con respecto a la Contraloría General del Estado, es otra entidad que sigue el camino de las anteriormente mencionadas. Gran parte de la población no conoce acerca de las actividades que estaría cumpliendo de acuerdo con lo que reza la CPE. Mucho menos sabe quién es su máxima autoridad ejecutiva. La misma se encuentra totalmente invisibilizada.

Ahora con el caso destapado del dirigente “decano” universitario, Max Mendoza, quien con 52 años y permaneciendo con 30 años como dizque “estudiante”, cobrando un jugoso sueldo de casi 22 mil bolivianos, también se pone en tela de juicio al sistema universitario público nacional. Aspecto que demuestra otra total vergonzosa desinstitucionalización y corrupción en el interior de esos entes de formación superior.

Todo esto tiene un origen, la llegada del MAS al poder desde el año 2006. Instrumento político que entró con ansias de barrer con todo lo que estaba ligado al republicanismo, al neoliberalismo y a la clase media tradicional que le dio su amplio voto para que esté donde ahora está. Un solo ejemplo de todo esto fue que, a partir de la mal diseñada idea que tuvieron para elegir mediante voto popular a magistradas/os de todos los estamentos que forman el Órgano Judicial y luego de llevarse a cabo las primeras elecciones judiciales realizadas en 2011, a partir del 2012 se empezó a desinstitucionalizar todos los cargos en los ámbitos jurisdiccional y administrativo, donde antes sí había técnicos especializados en sus funciones, que cumplían de manera profesional las mismas.

Así como van las cosas, sencillamente “Bolivia… se nos muere”.
