Former minister Juan Santos Cruz and a former vice minister sentenced to prison in the 2023 “Kickbacks” case in the Environment Ministry

The Litigation Directorate of the Office of the Attorney General of the State reported that the investigation concluded with a guilty verdict against five former officials, including Santos Cruz and Carmelo Valda Duarte.

Former Minister of Environment and Water, Juan Santos Cruz, was sentenced to 10 years in prison, while former Vice Minister of Drinking Water, Carmelo Valda Duarte, received a six-year prison sentence, as part of the 2023 “Kickbacks” case.

The decision was issued by the Second Sentencing Court in Criminal Anti-Corruption and Violence Against Women Matters of La Paz, within the proceedings initiated following a complaint filed on April 8, 2023.

The “Kickbacks” case was investigated after the detection of an alleged network that received irregular payments in exchange for awarding contracts within the Ministry of Environment and Water during the government of former president Luis Arce.

The Litigation Directorate of the Office of the Attorney General of the State reported that the investigation concluded with a guilty verdict against five former officials, including Santos Cruz and Valda.

The former minister had been held in pretrial detention at San Pedro prison since May 2023, while the former vice minister had been granted house arrest since July of that same year.

The list of those sentenced is completed by Jhony Alexander Santos Sánchez, Álvaro Chávez Arteaga, and Rosa Viviana Bautista, all receiving six-year prison sentences. In addition to the prison terms, those convicted are barred from holding public or elected office once the sentence becomes final.

The ruling also instructs the Public Prosecutor’s Office to identify and confiscate assets obtained illegally. The case allegedly caused economic damage to the State exceeding 19 million bolivianos.

The Office of the Attorney General of the State emphasized that this sentence sets a precedent in the fight against corruption and reaffirms the institutional commitment to defending the interests, sovereignty, and assets of the State.
