Cierra la Asamblea de los oprobios – Closes, the Assembly of reproaches

The Legislative Assembly that was installed in January 2015 closes its sessions as it developed them over almost six years: attacking democracy.

With just a few hours remaining until the end of its legislative term, the MAS decided to take advantage of its two-thirds of the votes to precisely annul the requirement of two-thirds of the votes in order to give governance to the president-elect Luis Arce Catacora, who did not achieve that type of majority vote in recent elections.

Although two-thirds of the votes are maintained in the Magna Carta to make appointments to high authorities of the State, to authorize liability trials and to approve the law requiring reforms to the Constitution, the outgoing legislators changed their regulations for decisions that make to the daily debate of the chambers, to approve appointments of ambassadors, to authorize army promotions to generals.

With this last-minute maneuver, the MAS leaves Comunidad Ciudadana (CC) and Creemos, parties with which it should be obliged to negotiate to make decisions by two-thirds of the vote, out of the agreement.

This manipulation shows that the MAS will continue to be the undemocratic, exclusive and authoritarian party that it was during the 14 years and that the calls for unity and reconciliation on the part of the winning team, for now, were only rhetoric without content.

The move is, at least, illegitimate, because it is an Assembly that is on its way out and that legislates for the new one that is to come with the intention of tying it to its old tricks. The change in regulations goes against the will of the people, which clearly established that the MAS must reach agreements with minorities. This, without counting that the new assembly members have already received their credentials, so the current parliamentarians had to close their sessions and go home.

This same Assembly that is leaving is also preparing to authorize the trial of responsibilities against at least 20 authorities of the government of Jeanine Añez, among them, the president, her ministers, as well as military and police chiefs, for the events of Sacaba and Senkata. In addition, having approved a law of court injunction that aims to prevent these citizens from leaving the country.

As we said at the beginning, the Assembly was marked by the constant attack against democracy and against the guiding principle of the separation of powers. The MAS turned Congress into an appendage of the power of Evo Morales.

A brief account of his disgraceful deeds leads us to remember that this same Assembly approved the constitutional reform that allowed Evo Morales to run for a fourth term and that it was rejected in the 21F referendum.

It was these same legislators who later appointed the candidates for magistrates and tribunes, who would later suspend various articles of the Constitution so that Morales can finally run, as was his decision.

And, it was the same congressmen who appointed the members of the previous Supreme Electoral Tribunal (TSE), who would later enable Morales’ candidacy and commit electoral fraud in his favor, fraud that was certified by the OAS and endorsed by the EU.

This same Assembly is the one that applauded all the Evo ministers who were questioned and who resigned from their supervisory role provided for in the Constitution.

All these decisions were adopted by the two-thirds of the votes that the MAS holds until today and that it loses from tomorrow. It must be remembered, it is the Assembly that was led by Álvaro García Linera, it is the Senate that was chaired by José Alberto Gonzales, Adriana Salvatierra and Eva Copa, and it is the Chamber of Deputies that was led by Gabriela Montaño, Víctor Borda and Sergio Choque. All of them, with two or three exceptions, are going home today with the weight of having contributed to the weakening of Bolivian democracy.

La Asamblea Legislativa que se instaló en enero de 2015 cierra sus sesiones tal como  las desarrolló a lo largo de casi seis años: agrediendo a la democracia.

Faltando apenas unas horas para que termine su gestión legislativa, el MAS decidió aprovechar sus dos tercios de votos para anular justamente el requisito de los dos tercios de votos con el objetivo de dar gobernabilidad al presidente electo  Luis Arce Catacora, quien no logró ese tipo de mayoría en las recientes elecciones.

Si bien los dos tercios de votos se mantienen en la Carta Magna para hacer designaciones de altas autoridades del Estado, para autorizar juicios de responsabilidades y para aprobar la ley de necesidad de reformas a la Constitución, los legisladores salientes cambiaron sus reglamentos para decisiones que hacen al debate diario de las cámaras, para aprobar nombramientos de embajadores, para autorizar ascensos a generales.

Con esta maniobra de último momento, el MAS deja fuera de la concertación a Comunidad Ciudadana (CC) y Creemos, partidos con los que debería estar obligado a negociar para tomar decisiones por dos tercios de votos.

Esta manipulación muestra que el MAS seguirá siendo el partido poco democrático, excluyente y autoritario que fue durante los 14 años y que los llamados a la unidad y a la reconciliación de parte del binomio ganador, por ahora, sólo fueron retórica sin contenido. 

La jugada es, cuando menos, ilegítima, porque se trata de una Asamblea que está de salida y que legisla para la nueva que está por venir con la intención de amarrarla a sus viejas mañas. El cambio de los reglamentos va a contramano de la voluntad popular que claramente estableció que el MAS debe concertar con las minorías. Eso, sin contar que los nuevos asambleístas ya recibieron sus credenciales, por lo que los actuales parlamentarios debieron clausurar sus sesiones e irse sus a casas.

Esta misma Asamblea que está de salida también se apresta a autorizar el juicio de responsabilidades en contra de al menos 20 autoridades del gobierno de Jeanine Añez, entre ellas, la presidenta, sus ministros, además de jefes militares y policiales, por los hechos de Sacaba y Senkata. Además, de haber aprobado una ley del arraigo que pretende impedir que estos ciudadanos salgan del país.

Como decíamos al inicio, la Asamblea estuvo marcada por la constante arremetida contra la democracia y contra el principio rector de la separación de poderes. El MAS convirtió al Congreso en un apéndice del poder de Evo Morales.

Un breve recuento de sus hechos oprobiosos nos lleva a recordar que esta misma Asamblea aprobó la reforma constitucional que permitía a Evo Morales postular a un cuarto mandato y que fue rechazada en el referendo del 21F.

Fueron estos mismos legisladores quienes luego nombraron a los candidatos a magistrados y tribunos, quienes posteriormente dejarían en suspenso varios artículos de la Constitución para que Morales pueda finalmente  postular, tal como era su decisión.

Y, fueron los mismos congresistas que nombraron a los vocales del anterior Tribunal Supremo Electoral (TSE), los que luego habilitarían la candidatura de Morales y cometerían el fraude electoral en su favor, dolo que fue certificado por la OEA y avalado por la UE.

Esta misma Asamblea es la que aplaudió a todos los ministros de Evo que fueron interpelados y que renunció a su rol fiscalizador previsto en la Constitución.

Todas esas decisiones fueron adoptadas por los dos tercios de votos que el MAS ostenta hasta hoy y que pierde desde mañana. Hay que recordarlo, es la Asamblea que estuvo dirigida por Álvaro García Linera, es el Senado que fue presidido por José Alberto Gonzales, Adriana Salvatierra y Eva Copa, y es la Cámara de Diputados que estuvo al mando de Gabriela Montaño, Víctor Borda y Sergio Choque.  Todos ellos, salvo dos o tres excepciones, se van hoy a sus casas con el peso de haber contribuido al debilitamiento de la democracia boliviana.
