Next week, Judge Marco Antonio Amaru must define whether he has jurisdiction to try Jeanine Añez by ordinary means or whether the former interim president should be brought to trial for the events in Senkata. The lawyer will have said decision in his hands, less than a year after being apprehended and presented to the public for allegedly favoring criminals.
As is recurring on the part of the Ministry of Government —despite criticism from human rights organizations—, in 2022 the police authorities presented Amaru to the media with an uncovered face. Then he was accused of favoring, irregularly, alleged criminals so that they achieve their freedom, according to Erbol recalled.
For this practice he was apprehended up to two times. The first was in March 2022, after having allegedly favored an alleged femicide in a Freedom Action, by using forged documents alleging that the inmate had cancer.
On that occasion, Amaru was benefited from house arrest and work outings by judge René Foronda, who, in turn, had been questioned shortly before for setting up a virtual hearing in an alleged drunken state.
Two months later, in mid-May, the judge was apprehended again for allegedly favoring an accused murderer, also through a Freedom Action.
That time he was released by his colleague Edwin Blanco, who is currently facing a trial for accusing, when he was a prosecutor, an innocent man for the alleged rape and death of baby Alexander.
And these are not the only cases. According to court records, at least seven acts of corruption and irregularities have occurred around Amaru’s career since 2012.
In addition, apart from his work as a lawyer, in the months prior to the presidential elections won by Luis Arce, Amaru participated as an active MAS militant and offered his support during the campaign, participating in the delivery of donations such as caps, T-shirts, and snacks.
To demonstrate his political weight among lawyers, at that time he published on his social networks photographs together with Evo Morales and the current State Attorney, Wilfredo Chávez, in addition to Arce himself.
A year later, despite the fact that the law prohibits political militancy by justice administrators, the Ministry of Justice, the Magistracy Council and the Supreme Court of Justice approved Amaru’s nomination and subsequent appointment as judge.
Senkata Case
The Minister of Justice, Iván Lima, reported days ago that an extension request was submitted to Amaru, current First Criminal Investigation Judge of El Alto, for Añez to be investigated for the crimes of genocide, homicide and serious and minor injuries, during the conflicts in Senkata. This, despite the fact that the case is already being processed within the Plurinational Legislative Assembly (ALP).
Next Tuesday, January 24, at 2:30 p.m., the hearing will be held in which the judge will define whether or not he has jurisdiction to judge the former president for the Senkata case.

La próxima semana, el juez Marco Antonio Amaru deberá definir si tiene competencia para juzgar a Jeanine Añez por la via ordinaria o si la expresidenta interina debe ser llevada a un juicio de responsabilidades por los hechos en Senkata. El letrado tendrá en sus manos dicha decisión, menos de un año después de haber sido aprehendido y presentado ante el público por presuntamente favorecer a delincuentes.
Como es recurrente por parte del Ministerio de Gobierno —pese a las críticas de organismos de derechos humanos—, en 2022 las autoridades policiales presentaron a Amaru ante los medios a cara descubierta. Entonces se lo acusó de favorecer, de forma irregular, a presuntos criminales para que logren su libertad, según recordó Erbol.
Por esta práctica fue aprehendido hasta en dos ocasiones. La primera fue en marzo de 2022, después de haber presuntamente favorecido a un supuesto feminicida en una Acción de Libertad, al utilizar documentos fraguados en los que se alegaba que el recluso tenía cáncer.
En dicha ocasión, Amaru fue beneficiado con detención domiciliaria y salidas laborales por parte del juez René Foronda, quien, a su vez, había sido cuestionado poco antes por instalar una audiencia virtual en presunto estado de ebriedad.
Dos meses después, a mediados de mayo, el juez fue aprehendido nuevamente por presuntamente favorecer a un acusado de asesinato, también a través de una Acción de Libertad.
Esa vez fue dejado en libertad por su colega Edwin Blanco, quien actualmente enfrenta un proceso por acusar, cuando era fiscal, a un inocente por la presunta violación y muerte del bebé Alexander.
Y estos no son los únicos casos. De acuerdo con los expedientes judiciales, al menos siete hechos de corrupción e irregularidades se dieron en torno a la carrera de Amaru desde 2012.
Además, al margen de su actuación como abogado, en los meses previos a las elecciones presidenciales que ganó Luis Arce, Amaru participó como activo militante del MAS y brindó su apoyo durante la campaña, participando en la entrega de donativos como gorras, poleras y refrigerios.
Para demostrar su peso político entre los abogados, en ese tiempo publicó en sus redes sociales fotografías junto a Evo Morales y el actual Procurador del Estado, Wilfredo Chávez, además del mismo Arce.
Un año después, pese a que la ley prohibe la militancia política de los administradores de justicia, el Ministerio de Justicia, el Consejo de la Magistratura y el Tribunal Supremo de Justicia aprobaron la postulación y posterior designación de Amaru como juez.
Caso Senkata
El ministro de Justicia, Iván Lima, informó días atrás que se presentó una solicitud ampliatoria a Amaru, actual juez Primero de Instrucción en lo Penal de El Alto, para que Añez sea investigada por los delitos de genocidio, homicidio y lesiones graves y leves, durante los conflictos en Senkata. Esto, pese a que el caso ya se encuentra en trámite dentro de la Asamblea Legislativa Plurinacional (ALP).
El próximo martes 24 de enero, a horas 14:30, se llevará a cabo la audiencia en la que el juez definirá si tiene competencia o no para juzgar a la exmandataria por el caso Senkata.
La libertad no tiene precio.
