Scandalous justice
The case of the ghost items in the mayor’s office of Santa Cruz de la Sierra, the announcement of a summit as a way for judicial reform, the spectacular deployment to arrest a former civic leader of Potosí and the official attitude regarding these issues sketch a landscape nothing encouraging about the possibility of straightening out the institutional collapse of the administration of justice in our country.
The case of at least 800 items of municipal employees who neither worked nor existed other than as the holders of bank accounts where the Santa Cruz mayor’s office deposited in each one, on average, 5,000 Bolivianos per month, for a decade, was discovered due to the complaint of the ex-wife of the main person responsible for the act that she is pursuing in court for non-compliance with family assistance.
The complainant provided unquestionable evidence that the Prosecutor’s Office had to take seriously and not with the disdain it had given the case since April, when the municipal administration raised it with the Public Ministry in September, providing evidence.
Without the complaint of the lady in question, the matter would not be the scandal that it is now, because the Prosecutor’s Office did not do its job as required by law. And not only that, but the ruling party -so willing to praise prosecutors when they act according to their interests, and to threaten them when they are slow to persecute what the MAS describes as “coup plotters”- recovers the matter for their political benefit, pretending to involve in the case of civic leaders and opponents improvising connections that compete with each other for the absurdity.
This scandal whose economic impact and magnitude due to the length of time the robbery lasted and the number of people involved conceals another greater one, which is the incapacity, or convenient negligence, of the Public Ministry, about which the Minister of Justice says nothing.
But it does refer to judicial reform, announcing a summit for three months from now -the third one promoted by the MAS for that purpose- that will decide the course of an urgent process whose execution is demanded by at least five international bodies and the Bolivians yearn for.
That announcement came after the latest report from a UN body that is lapidary about the deinstitutionalization of justice, disrespect for the laws and, especially, due process.
Due process that prosecutors and judges blatantly ignore when it comes to persecuting opponents, as happened a few days ago in the arrest of the former civic president of Potosí, in the midst of a spectacular police deployment that recalled the worst times of the military dictatorships.
In this context, it is inevitable to verify the total lack of political will, but rather an eagerness that goes in the opposite direction, to recover the institutionality of the state instances, starting with the most important with regard to the rule of law: the administration of justice, currently subjected as ever to the power of the ruling party.

El caso de los ítems fantasma en la alcaldía de Santa Cruz de la Sierra, el anuncio de una cumbre como vía para la reforma judicial, el aparatoso despliegue para detener a un exlíder cívico de Potosí y la actitud oficialista respecto de esos temas bosquejan un paisaje nada alentador acerca de la posibilidad de enderezar el descalabro institucional de la administración de justicia en nuestro país.
El caso de al menos 800 ítems de empleados ediles que ni trabajaban ni existían más que como los titulares de cuentas bancarias donde la alcaldía cruceña depositaba en cada una, en promedio, 5.000 bolivianos mensuales, desde hace una década, se descubrió debido a la denuncia de la exesposa del principal responsable del hecho al que persigue en justicia por incumplimiento de asistencia familiar.
La denunciante aportó pruebas incuestionables que la Fiscalía tuvo que tomar con seriedad y no con el desdén que le prestó al caso desde abril, cuando la administración municipal lo planteó en septiembre al Ministerio Público, aportando pruebas.
Sin la denuncia de la dama en cuestión el asunto no sería el escándalo que ahora es, pues la Fiscalía no hizo su trabajo como manda la ley. Y no solo eso, sino que el oficialismo — tan dispuesto a elogiar a los fiscales cuando actúan siguiendo sus intereses, y a amenazarlos cuando son lentos para perseguir a los que el MAS califica de “golpistas”— recupera el asunto en su beneficio político pretendiendo involucrar en el caso a líderes cívicos y opositores improvisando conexiones que compiten entre ellas por lo descabellado.
Ese escándalo cuyo impacto económico y magnitud por el tiempo que duraba el robo y la cantidad de gente involucrada disimula otro mayor que es el de la incapacidad, o conveniente negligencia, del Ministerio Público, acerca de la cual nada dice el Ministro de Justicia.
Pero sí se refiere a la reforma judicial, anunciando una cumbre para dentro de tres meses —la tercera que impulsa el MAS con ese fin— que decidirá el derrotero de un proceso urgente cuya ejecución la reclaman al menos cinco instancias internacionales y anhelan los bolivianos.
Ese anuncio surgió luego de conocerse un último informe de una instancia de la ONU que es lapidario acerca de la desinstitucionalización de la justicia, el irrespeto de las leyes y, especialmente, del debido proceso.
Debido proceso que fiscales y jueces ignoran con descaro cuando se trata de perseguir a opositores, como ocurrió hace pocos días en la detención del expresidente cívico de Potosí, en medio de un despliegue policial aparatoso que recordó los peores tiempos de las dictaduras militares.
En ese contexto, es inevitable constatar la total falta de voluntad política, sino más bien un afán que va en sentido contrario, para recuperar la institucionalidad de las instancias estatales, comenzando por la más importante en lo que respecta al Estado de derecho: la administración de justicia, actualmente sometida como jamás al poder del oficialismo.
